We advise our clients to read thoroughly our Terms and Conditions and make sure to understand them before using our platform and services. Please note that by using our website and services you agree to our Terms and Conditions.

USE OF OUR WEBSITE

We reserve the right to change anything on our website at any time. If possible, we will issue a warning beforehand and keep the time of disruption as short as possible. We have no responsibility for any other website other than our own, even if linked.

Our users are responsible for all electronic communications and content sent to us. They must use the website for lawful purposes only.

Our website cannot be used for any of the following:

  • To breach any local, national, or international law or regulation.
  • To pursue any fraudulent, unlawful purpose or effect.
  • To send, use or reuse any material that is: in breach of copyright, trademark, confidence, privacy or any other right, illegal, offensive, abusive, indecent, racist, discriminatory, defamatory, obscene or menacing, which consists of or contains software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any “spam”. 

Any breach of these clauses will constitute a criminal offence under the Computer Misuse Act 1990. We will report any breach to law enforcement and disclose the identity of the criminal. Any breach of these Terms and Conditions will be indemnified in full to us against all expenses, liabilities, damages and losses.

We are not liable for any technologically harmful material that may infect our client’s computer equipment, computer programs, data or other proprietary material due to their use of the website or to downloading of any content on it, or on any website linked to it.  We are also not liable for any damage or loss caused by a virus.

YOUR ACCOUNT

If you choose to open an account with us, you will need to log on to our website using your login and password. This will grant you access to the information stored in your account. The account name and password must be confidential. In case your account is being used without your permission or if you believe the security of your account has been compromised, please contact us as soon as possible at contact@lalucegioielleria.com. The clients are responsible for all the activities performed on their accounts. Please verify that all the information is correct and complete and inform us promptly of any changes. This information can be corrected when you log on to your account. We may, at any time and our discretion, suspend, modify or close any account.

PLACING YOUR ORDER

The moment you place an order with us, you are offering to buy the items you order. Until we decide to accept the order, we are in no responsibility to supply the items at that price or at all. Goods are subject to availability. If we cannot meet your order or if your order could be delayed, we will inform you as soon as possible. In the unlikely case that we become aware, before we deliver the item, that the price description is not right, we will contact you and inform you. In this case, you would have 2 choices: to accept the new price and continue with the order or cancel the order that will be fully refunded. If we do not receive any indication from you within 3 working days, we will assume the order to be cancelled.

Once we receive the payment, we will send you an email accepting your order. There is then a binding contract.

We may share your details with third parties for address, identity and credit checks. This helps secure us and our clients from fraud.

You further agree that you will not export, re-export, or otherwise transfer the products to countries or territories that are the target of comprehensive embargoes, sanctions or to parties identified on the U.S. Treasury Department’s List of Specially Designated Nationals and Blocked Person List or the E.U.’s Consolidated Financial Sanctions List.

By placing an order, you guarantee that all the details you provided are true and accurate, that you are over 18 years old, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds in the account to cover the cost of your order.

PRICE

To all of the countries listed below the price is inclusive of shipping. Eventual customs and duties are the responsibility of the customer. For non-listed countries please contact us and we will supply all the eventual additional costs. The client must pay the item when placing the order unless agreed otherwise.

If you would like us to take care of customs and duties we can certainly do so at an extra price, depending on the shipping location. Please note that this price includes all customs and duties and the paperwork needed to deliver the item directly to your door. The price of our custom works includes: shipping, insurance and eventual customs, duty and paperwork.

We offer express delivery free of charge to the countries listed below.

All our deliveries are “all risks door-to-door” insured.

Depending on the location, the delivery may take from 2 to 6 working days. We ship from Italy, therefore if the item has to undergo customs, the shipment may be delayed. If your country isn’t listed below, please contact us to see if we can arrange a special delivery. Please note that this could result in added shipping and customs fees.

As soon as the order is ready to be dispatched, you will receive an e-mail with all the courier details. If necessary, we can arrange a faster delivery depending on the location. Please contact us at contact@lalucegioielleria.com.

All delivery times quoted are estimates only and we cannot guarantee delivery at any particular time or date. Please note that if an item needs to go through customs, it may result in delays.

CUSTOMS AND DUTIES

We strive to offer the best possible service.

Regarding our custom works:

The price of our custom works includes all eventual customs, duties and paperwork. The item will be shipped directly to your door unless otherwise agreed.

(An item is considered custom if it’s made from start to finish for a client and sold through this platform, a modification or an engraving will not be considered a custom jewel, but a customised jewel).

Regarding our ready-to-buy items:

For any extra-EU shipment, the customs and duties are the responsibility of the customer. If you would like us to take care of customs and duties we can certainly do so at an extra price, depending on the shipping location. Please note that this price includes all customs, duties and the paperwork needed to deliver the item directly to your door.

If you would like to know the customs and duty fees please check https://trade.ec.europa.eu/access-to-markets/en/  using the HS code “7113”. In addition to these duties, each country applies its VAT. In most countries, this is the total amount due for custom clearance. Please check with your customs before any extra-EU purchase.

For any extra-EU shipment please note that customs may cause delays we can’t foresee.

DELIVERY AND RISK

The item ordered is at the client’s risk from the time of delivery. Once delivered, the order must be inspected. If any item is damaged or not delivered, you must inform us within 3 working days of delivery. After that period, the client must supply proof that the items were lost or damaged before delivery. We must, moreover, have a fair chance to inspect the item.

CANCELLATION

In case any of these circumstances occur, we may suspend or cancel your order:

  • If the client fails to pay the order when due.
  • If the client fails to honours their obligation under these Terms and Conditions.
  • The client may not cancel the order unless agreed in writing.
  • The client may not cancel the order if any items are custom made, engraved, or personalized in any way.

Except for certain types of products (for example bespoke orders), you may cancel a contract at any time before your order is shipped for a full refund. If you would like to cancel an order once it has shipped, please contact us as soon as possible. If the order has already been delivered, please refer to the returns policy.

The cancellation will be on the basis that you have no further claim against us under that contract. If you accept delivery of the goods after the estimated delivery time, it will be on the basis that you have no claim against us for the delay.

WARRANTIES

We warrant that the goods:

  • Satisfy the description on our website and are free from material defects at the time of delivery.
  • As our products are completely handmade, the pictures on our website are for identification only. The items may vary slightly from their description in weight, appearance, dimensions, technical specifications and performance.

If you believe the delivered item is defective in material or workmanship, you must:

  • Inform us (in writing), as soon as possible or within 3 days, with full details and allow us to investigate (we may need access to your premises or for you to send us the items).

If we agree that the item is defective, we will repair it free of charge, if it’s not possible to repair the item, it will either be replaced or the client will receive a full refund.

We are not liable for any other loss or damage (including indirect or consequential loss, financial loss, loss of profits or loss of use) arising from the contract or the supply of goods or their use, even if we are negligent. For all other liabilities not referred to elsewhere in these Terms and Conditions, our liability is limited in damages to the price of the goods.

 

LIFETIME MANUFACTURER WARRANTY

If you believe your item has a manufacturing defect, you may return it to us for inspection. If we determine that your jewel is damaged due to a manufacturing defect, our goldsmith will repair it free of charge.

We suggest to let us handle repairs of our jewellery as It will be easier for us compared to other goldsmiths.

If we determine that the damage is not caused by a manufacturing defect, we will notify you and let you know if repair services are available at a cost or otherwise.

Please note that slight irregularities and variations in craftsmanship, natural characteristics, or internal inclusions, visible or otherwise, in coloured gemstones are unique and individual to each item. These characteristics are considered as part of the character of the item, and should not be considered a flaw.

CONDITIONS AND EXCLUSIONS

However meticulously jewels can be made, they are not invulnerable to normal wear and tear. We do not provide warranties for damage due to normal wear, product loss, loss of stones or theft. Damage or loss that results from failure to obtain the repairs necessary to maintain the integrity of the product is also not covered.

Repair or service performed by a third party other than La Luce will void this guarantee. This guarantee is non-transferrable. All guarantee claims under the La Luce Lifetime Guarantee must be made by the original purchaser or gift recipient.

You must provide identifiable pieces of jewellery for La Luce to honour this guarantee. If the goldsmith determines that it did not manufacture the original piece, it is under no obligation to honour this guarantee.

RETURNS

We offer a free shipping, 14-day return policy for non-customised items for a full refund from any European country. If the item had to undergo customs returning to Italy, these fees will be detracted from the total refund. Accordingly, for any extra-EU return the refund will equal: total price minus Italian customs and duties.

We do not offer refunds for customised items. If there is any issue with the custom jewellery you purchased please contact us and we will do our best to find a solution.

To return an item, we recommend contacting us within 3 days of receiving it. All returned items must comply with the following:

  • returned unused and unworn, in the same condition they have been received in.
  • returned in their original package with all the original documentation.
  • Earrings may not be tried on for hygiene reasons.
  • Our bigger pieces come with a bright red thread that works as a “tag”, if it has been removed or its position significantly changed, we will not accept the return.

If you wish to return an item, please contact us at contact@lalucegioielleria.com with your name, address and order number. We will provide a free return shipping label and a link to schedule a convenient time for our courier to collect the package from your address.

Once we receive the item, it will be inspected. If it meets all the requirements, we will proceed to a refund. Please allow up to 7 working days for the refund.

OUR LIABILITY TO OUR CUSTOMERS

If we fail or neglect to comply with these Terms and Conditions, we are responsible for any foreseeable loss or damage you might suffer, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time you started using our services.

INTELLECTUAL PROPERTY, SOFTWARE AND CONTENT

We are the owner or the licensee of all intellectual property rights in the website and its content (such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations and software including the presentation and compilation of the same). The rights in the website and the content are protected by international copyright laws as well as by any relevant national law concerning copyright, authors’ rights and database right laws. All such rights are reserved. Any trademarks or names featured on the website are owned by the respective trademark owners.

Nobody can systematically extract or re-utilise parts of our website or our content. In particular, nobody can use any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for the re-utilisation of any substantial parts of the website. Nobody can create or publish a database that features substantial parts of our website without our prior written consent.

ETHICAL SOURCING POLICY

Ethical sourcing is a pillar of our brand. As so, we are not willing to compromise. We are aware that our supply chain can be delicate, due to some political and economic circumstances in the countries we source from. In any case, we want our supply chain to be as transparent as possible. If for any reason, we are unable to source any of our materials due to events outside of our control, we will notify our client immediately and find a different but equally ethical source. We will not be liable for possible delays caused by these events outside our control.

GOVERNING LAW AND JURISDICTION

Anything related to your order, use of the website or these Terms and Conditions are governed by Italian law. To the fullest extent permitted by law, the courts of Italy shall have exclusive jurisdiction over any dispute or claim relating to these Terms and Conditions.

Every item sold by “La Luce di Joy Harvey e Marco Rossi snc” is sold in Via San Giovenale 86, 47922 Rimini, Italy, where we produce all of our jewellery.

We accept payments through PayPal. When processing payments, some of your data will be passed to PayPal, including information required to process or support the payment, such as the purchase total and billing information.
